A word of caution regarding the NRC of Assam

When the central govt & the supreme court started the Assam NRC process, not many people asked any question. The reason was simple. There was huge hue and cry about foreigners infiltrating assam. And in one case the honourable supreme court even called such incursion as invasion of a country. All good so far. Problem arose when the draft list of NRC was published in 2018 july. And 40.1 lakhs people were excluded from it. Immediately the BJP chief, mr Amit Shah called all 40.1 lakhs people as foreigners and used the word deemak (insects) to describe. and also called for them to thrown out of the country. along with that came the news of hundreds of people from other states like bihar, up and west bengal who have been jailed for not being able to produce documents to prove their citizenship. people like the grand nephew of former president Fakruddin ali ahmed have been excluded from NRC. in one case a retired army officer namely sonaullah was arrested for being a foreigner.

But, those cases of injustice apart, no one in this great country analysed the legality of the NRC process.

On 8th September, 2019, came the complete and comprehensive analysis of the legality of the  NRC process.  Faizan Mustafa, vice-chancellor of the NALSAR University of Law, explains the major legal problems with how the National Register of Citizens was conducted in Assam to Karan Thapar. He described the NRC as illegal, unconstitutional and and unethical. The reason, it violates the citizenship act of 1955. Also, he said, there cannot be two citizenships. One for India, another for assam.

But the central govt seemed unconcerned that such an illegality is being perpetrated at such a large scale. But of course, everything about assam has always been illegal. 
But let us analyse the outcome of final NRC published on 31st august 2019.

It excludes around 19.1 lakh people from the final list. Out of which 4.5 lakhs people are dead. and further 4 lakh people are those who have their brother, mother, sister, father etc included in NRC. That means they are citizens but NRC officials did not include them.Add further 3 lakhs women who could not establish their linkage with their fathers. They are those women, who have no birth certificate, they never went to school, and were married at an young age. their name were first enlisted in electoral rolls when they attained the age of 18. Since they were born at home and never went to school, they have no document to prove their linkage with their father.
So, if you leave out all these people, then the suspected number of foreigners in assam will be around 1 lakhs, if at all any is found.
So, now when we analyse the entire NRC exercise as a whole, it can be said to be a disaster.

NRC perocess a diisaster


On 01 sept 2019, Farzan Mustafa, the VC of National Law university analysed and showed us how a false narrative was created by AASU , AGP, BJP, RSS to the affect that a huge influx of foreigners had taken place from bangladesh to assam. The supreme court of the country got carried away. Their were report submitted by lt gen SK sinha, former governor of assam, who emphasised that a huge influx of foreigners is taking place thru indo bangladesh border.
But upon detailed analysis and after employing 62000 people to scrutinize all residents of assam and after having proven their ancestry, from govt records, it was found that less than 1 lakhs people are there who cannot prove their citizenship.

And the way it has been prepared, the excluded list includes many people from Bodo, Koch, Rajbangshi, Rabha, Tiwa community etc, as well as genuine assamese people. so if analysed properly on community basis, these people have no chance of being a foreigner.

So that is what it comes to. that is the reality of assam. all propaganda, no truth.

The list is endless. All those not included in NRC have genuine claim to citizenship of this country. and as such they are all citizens.

Victimisation: Those who are excluded from NRC, can genuinely say they were victims of a cruel process.

Since any unknown person could file objection to anyone's name being included in NRC or accuse anyone of being foreigner, this is an open area for victiming any person. . And hence that person's name will be struck off from NRC and he/she will have to prove in Foreigner's tribunal that he is indian citizens, still his name may not figure in NRC.


Mental torture:
A huge numbers, estimated at 89% of those who were excluded in 2018 draft, are suffering from Anxiety.

A survey showed 89% of the respondents suffering from extreme anxiety, 10% from moderate and 1% from mild anxiety. This, the study said, is leading to sleep disorder, appetite loss, affecting thought process and work, and causing a feeling of shame and isolation
